1. What information do we collect from you?

In order to better provide you with our numerous services, we collect two types of information about our users: Personally Identifiable Information and Non-Personally Identifiable Information. Our primary goal in collecting information from you is to provide you with a smooth, efficient and customized experience while using the Site.
Personally Identifiable Information: This refers to information that lets us know the specifics of who you are. When you engage in certain activities on the Site, such as registering for our service, submitting and/or posting content, requesting a demonstration of our service, filling out a survey, or sending us feedback, we may ask you to provide certain information about yourself by filling out and submitting an online form. Depending on the service or product you are interested in, we may ask that you provide us with personal information, such as your first and last name, work title, company name, telephone numbers, email address, date of birth, social security number, details of family members, financial information, and details about your medical conditions, prescribed medications, and other health and wellness-related information. Depending upon the activity, some of the information we ask you to provide is identified as mandatory and some as voluntary. If you do not provide the mandatory data with respect to a particular activity, you will not be able to engage in that activity.
Non-Personally Identifiable Information: This refers to information that does not by itself identify a specific individual. We gather certain information about you based upon where you visit on the Site in several ways. This information is compiled and analyzed on both a personal and an aggregated basis. This information may include the Uniform Resource Locator (“URL”) of the website from which you just visited before coming to the Site, the URL which you go to next, the type of browser you are using, and your Internet Protocol (“IP”) address.2. How do we collect information from you and how do we use it?
We collect Personally Identifiable Information about you when you voluntarily provide it to us. For example, you provide certain Personally Identifiable Information to us when you: (a) register for our services or register your e-mail address with us; (b) request a demonstration of our service; (c) sign up for special offers; (d) send e-mail messages, submit forms or transmit other information to us by telephone or letter; or (e) submit your credit card or other payment information if we make such payment functionality available on the Site and you use it to order and purchase products or services. We may also receive Personally Identifiable Information from your employer as we set up your account, and may receive Personally Identifiable Information from your insurance provider or other third parties that are requested or authorized by you.
We also collect certain Non-Personally Identifiable Information. For example, we may automatically collect some information when you visit the Site, such as your computer’s IP address, operating system, and the time and date of your visit.
We may also process Personally Identifiable Information to provide our products and services – such as audit, research and analyze data to maintain, protect and improve our services; ensure the technical functioning of our network; and developing new services.
We will not collect or use Personally Identifiable Information for purposes other than those described in this Policy and/or in the specific service notices, unless we have obtained your prior consent.3. With whom do we share your information?
We may also access and disclose your personal information in the event that we were to sell or buy any business or assets, in which case we may disclose your Personally Identifiable Information to the prospective seller or buyer of such business or assets, and if Lumity or substantially all of its assets were to be acquired by a third party, information about our subscribers would likely be one of the transferred assets. Additionally, we may disclose Personally Identifiable Information as may be permitted or required by law, regulation, rule or court order; pursuant to requests from governmental, regulatory or administrative agencies or law enforcement authorities; or to prevent, investigate, identify persons or organizations potentially involved in, or take any action regarding suspected fraud, violations of our Terms and Conditions of Use, or activity that appears to us to be illegal or may expose us to legal liability; in situations that we believe to be emergencies involving potential threats to our physical safety or to protect the rights, property, or safety of Lumity, our subscribers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.4. How can you update, correct, or request the removal of your Personally Identifiable Information?
We believe you should have the ability to access and edit the Personally Identifiable Information that you have provided to us. You may change any of your Personally Identifiable Information in your account online at any time by linking to your account in accordance with instructions posted elsewhere on the Site. We encourage you to promptly update your Personally Identifiable Information if it changes. As an employee, you can cancel your account if and when you leave your employer.5. How long do you keep my information?
Your historical medical data will be retained indefinitely to provide accurate comparisons when evaluating and determining the best course of action for your employer when selecting new plans and benefits for a new enrollment period.6. What are your choices regarding collection, use, and distribution of your information?
We may, from time to time, send you correspondence regarding our products and services. In addition, if you indicated upon registration that you are interested in receiving offers or information from us and our partners, we may occasionally send you direct mail and/or e-mails about products and services that we feel may be of interest to you. We will send you these e-mails or direct mailings only if you indicated that you do not object to these offers. You can easily edit your account’s subscription preference information at any time to opt out of receiving such offers and mailings.
You also have choices with respect to cookies, as described below. By modifying your browser preferences, you have the choice to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose to reject all cookies some parts of the Site may not work properly.7. What security precautions are in place to protect against the loss, misuse, or alteration of your information?
In addition, access by you to your Personally Identifiable Information is available through a password and unique customer ID selected by you. This password is encrypted. We recommend that you do not divulge your password to anyone. In addition, your Personally Identifiable Information resides on a secure server that only selected company personnel have access to via password. We encrypt your Personally Identifiable Information when it is transmitted between You and us to prevent unauthorized parties from viewing such information during transmission.
Information that you provide that is not Personally Identifiable Information also resides on a secure server and is only accessible via password. Since this information is not accessible from outside the company you will not be asked to select a password in order to view or modify such information.
Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your Personally Identifiable Information, you acknowledge that: (a) there are security and privacy limitations of the Internet which are beyond our control; (b) the security, integrity and privacy of any and all information and data exchanged between you and us through this site cannot be guaranteed; and (c) any such information and data may be viewed or tampered with in transit by a third party.8. Do we use “cookies”?
